警告/求助：EBS向我索要1万欧

各位申请商科硕士的同学们，

我来向大家汇报一个情况。1是希望大家警惕EBS的合约条款，我从未见过有如此厚颜无耻之学校。2是希望如果有同学有在德国打官司的经验，请与我联系。谢谢啦！

我在EBS参加完面试后于3月2号收到了录取的邮件通知，并在翌日收到了纸质的录取通知，并要求在3月14日前签署合同。在仔细浏览了合同的每个条款之后（我本科在德国有上过BGB），我签字并将合同寄了回去。在3月16日，我收到了EBS的第二封信，要求1在8月1日前提交本科毕业证，2在4月1日前支付约600欧的注册费，在4月15日前支付约9400欧的一学期学费。我要注明的是，这两项要求在之前第一封信中没有出现过，而且第一封信也完全没有申明过conditional offer的概念。

由于我1不能在8月1日前毕业 2难以理解为什么要这么早交学费 3有更好的学校录取了我，所以在4月4日向EBS写了邮件要求撤销我的合同。然后我得到了这样的回答：

I am sorry but I have to inform you that in case that you cannot attend your study in fall term 16 you have to pay the invoice for the initial payment and the tuition fee for the fall term 2016 in any case. You already signed the study contract which is binding. Please have a look at the study contract. Paragraph 2 (3) says:

“The agreement can be terminated in writing by the student subject to a four-week notice period, effective at the end of a term. A first notice of termination is, however, only permitted effective at the end of the term for which the study agreement was concluded.” This means that you can cancel the contract by the end of the fall term 2016 at the earliest.

但即使这样，我觉得我也有理由拒付 1。我无法达到你的录取要求 2。我没有签署你第二封信要求的新的条件。

希望大家可以帮我参谋一下这个事情，我已经准备诉诸法律了。

楼主是这样的，在香港也有类似的情况，我们一般称作留位费。
我认为是学校为了保证虽然生源不好，但是也可以有一点钱收入的做法。

不去可以不交，不用理会。

请问一般交了留位费之后不去了，钱也不要了，会有影响吗？
